Nintendo has taken legal action against accessory manufacturer Genki, filing a lawsuit in California against its parent company Human Things. The suit alleges trademark infringement, unfair competition, and false advertising related to Genki’s actions surrounding the yet-to-be-released Nintendo Switch 2 console.
According to court documents, Nintendo is seeking damages and demands that Genki destroy all products related to both the Nintendo Switch and upcoming Nintendo Switch 2, as well as cease using Nintendo’s trademarks in the future. The gaming giant is requesting that damages be trebled as compensation for Genki’s alleged misconduct.
The lawsuit outlines what Nintendo describes as a timeline of Genki’s wrongdoing, beginning in December 2024 when the company publicly tweeted to GameStop CEO Ryan Cohen about “the launch switch 2 accessories [Genki was] working on,” despite the console not being officially announced at that time.

The situation escalated in January 2025 at the Computer Electronics Show (CES), where Genki’s exhibition page stated they were “Happy to discuss any Switch 2 info we may have as well as the stuff we’re making for it.” During the event, Genki CEO Edward Tsai reportedly showed 3D-printed mockups of the device to journalists, claiming the company had access to an authentic Switch 2 on which they based their designs.
Nintendo further alleges that Genki representatives conducted multiple media interviews discussing eight accessories they had developed, supposedly confirming specific design elements and functionality of the unannounced console. Reports indicate that Nintendo lawyers approached Genki on the CES showroom floor following these revelations.

The lawsuit also points to Genki’s display of a video at CES featuring a rendered image of the Nintendo Switch 2, complete with Nintendo trademarks including the official logo. Additionally, Nintendo cites a social media post showing Genki’s CEO with the caption “Genki ninjas infiltrate Nintendo Kyoto HQ,” which Nintendo claims was “an apparent attempt to further confuse the public” about Genki’s relationship with Nintendo.
In April, one day before Nintendo’s official Switch 2 presentation, Genki allegedly sent mass emails and posted on social media announcing their own “Direct” presentation, which Nintendo contends infringes on its Nintendo Direct branding. The Nintendo Switch 2 is scheduled for release on June 5.
