Nintendo has won a lawsuit against streamer Jesse Keighin, who broadcasted pirated Switch games online while mocking the company. Using the name Every Game Guru, Keighin streamed at least 10 leaked Nintendo titles since 2022, often before release.

One of these was Mario & Luigi: Brothership. He even bragged to Nintendo, saying he had “a thousand burner channels” and could “do this all day.”On Facebook, Keighin taunted the company again, writing:
“Should have done more research on me. You might run a corporation, I run the streets.”
Nintendo’s legal team claimed he evaded service of the complaint. The company then delivered the lawsuit through emails and letters to his relatives. When Keighin failed to respond, the court clerk issued a default ruling in March 2025.
Court Orders $17,500 in Damages
A Colorado federal court has now ruled in Nintendo’s favor. Keighin must pay $17,500 in damages, which includes $10,000 for streaming Mario & Luigi: Brothership and $7,500 for 15 anti-piracy violations.

Nintendo stated it could have sought over $100,000 in damages for the other nine games but chose not to. The decision reinforces Nintendo’s reputation for pursuing copyright cases aggressively and demonstrates how seriously the company treats early game leaks and online piracy.
In its motion, the company said:
“An award of $10,000 is eminently reasonable for Defendant’s blatant streaming of Nintendo’s video games before any ordinary consumer had lawful access.”
Two Injunction Requests Denied
The court denied two of Nintendo’s injunction requests. The judge ruled that asking Keighin to “destroy all circumvention devices” was unclear and unreasonable, since the tools were public emulators.

Nintendo also wanted the injunction to cover “unnamed third parties” connected to Keighin. This was rejected for lack of clear identification. Despite these denials, the ruling marks another strong win for Nintendo. It reinforces the company’s strict stance against piracy and pre-release leaks.
Nintendo continues to monitor online activity closely, reaffirming its commitment to protecting game developers and maintaining fair play across the Nintendo Switch community as future releases approach.
